Mustang Development LLC is pleased to report that it has settled a significant lawsuit with the Town of Hideout. This settlement comes on the heels of another recent settlement with the Town, related to the non-payment of impact fees that had been collected by the Town under an agreement between the parties. The current lawsuit was brought in response to the Town taking the position that Mustang Development had fewer units to develop than set forth under the parties’ development agreement. The Court rejected this argument; the Town was required to affirmatively pass a resolution affirming Mustang’s development rights.
The Court also determined that Mustang was the prevailing party in the litigation and that the Town was required to reimburse Mustang Development for its legal fees. The amount of legal fees incurred in the case was in excess of $350,000 and has continued to grow. However, based on Mustang’s continued commitment to the community, it has agreed to reduce the amount to $250,000.
There are still two remaining lawsuits that exist and Mustang Development and the town of Hideout have agreed to attempt to use a mediation process; however, if no resolve comes out of mediation, the two will finalize the damage claim in the fourth District Court.
Mustang Development has been willing to work with the new administration in resolving these litigation matters which also limited/restricted the ability to invest in additional amenities-improvements in Hideout that were caused by the previous administration.
